- Introduction and General Provisions
These Terms of Service (“Terms”) govern the contractual relationship between Baycushionnest (“we,” “us,” or “our”), operated in Bulgaria, and any consumer (“Customer” or “you”) purchasing products from our official website, www.baycushionnest.com. By placing an order through our website, you agree to be bound by these Terms.

These Terms comply with applicable Bulgarian legislation, the European Union Consumer Rights Directive, and standard requirements for secure electronic commerce transactions.
- Orders, Processing, and Fulfillment
Order Processing: Orders are typically processed and prepared for dispatch within 1 to 3 business days following successful order placement and payment verification.
Logistics and Shipping: We partner with premier international logistics providers, including DHL, FedEx, and UPS Priority services, to deliver products directly to customers across Europe.
Delivery Timelines: Standard delivery is expected within 5 to 7 business days from the date of dispatch.
Tracking Notifications: To ensure transparency, automated tracking updates and shipment milestone notifications are sent directly to the email address provided by the customer at checkout, covering key transit events including dispatch, arrival at regional logistics hubs, and local final-mile delivery.
Transit Delays and Resolution: If a shipment exceeds standard transit timelines, we initiate a formal carrier investigation. Based on the findings of the investigation, appropriate remedial measures, including full refunds or replacement dispatches, are applied in accordance with operational circumstances.
- Risk of Loss and Transfer of Ownership
In strict adherence to mandatory European consumer protection laws, the risk of loss or damage to goods remains with Baycushionnest during transit. The risk of damage or loss of goods transfers to the customer only upon physical receipt of the goods—specifically when the consumer, or a designated third party other than the carrier and indicated by the consumer, acquires physical possession of the goods.
- Right of Withdrawal and Returns (14-Day Period)
Statutory Withdrawal Right: As our target market is within Europe, consumers benefit from a statutory 14-day Right of Withdrawal without needing to provide any justification. The withdrawal period expires 14 days after the day on which you acquire, or a third party other than the carrier acquires, physical possession of the goods.
Exercising Withdrawal: To exercise the right of withdrawal, you must inform us of your decision via an unequivocal statement sent to our customer service email at cushion@baycushionnest.com before the 14-day period expires.
Damaged or Defective Items: If an item arrives damaged, defective, or not as described, customers may contact our after-sales support via email, providing photographic evidence of the issue. For verified damaged or defective items, customers are not required to physically return the damaged item; upon receipt and verification of sufficient photographic proof, we will process a full refund or arrange a replacement dispatch.
- Governing Law and Dispute Resolution
These Terms and any separate agreements whereby we provide services to you shall be governed by and construed in accordance with the laws of Bulgaria and applicable European Union regulations. Any disputes arising out of or relating to these Terms shall be subject to the non-exclusive jurisdiction of the competent courts in Bulgaria, without prejudice to mandatory consumer protection rights available under the laws of the consumer’s country of habitual residence within the European Union.
